What Is A Lasting Power of Attorney?

Just as a Will details your wishes regarding what is to happen after you have passed away, a Lasting Power of Attorney (LPA) details what you want to happen if you are incapacitated for any reason.

An LPA is a legal document that allows you to give someone you trust (your Attorney – a named person or people) the authority to make decisions on your behalf should you no longer have the mental capacity or ability to make your own decisions.

It enables them to legally make decisions about your own financial matters or personal wellbeing that you are no longer able to make for yourself. Subject to certain conditions and safeguards an LPA continues in force until death.

LPAs are legal arrangements and as such they need to be officially registered with the Office of the Public Guardian before they become effective. Because of this they must be prepared well in advance of the time that they may be required.
